1. Introduction
These Terms of Use ("Terms") govern your access to and use of the Daily Dilemma mobile application and any related services, features, content and functionality (collectively, the "App"). The App does not ask you to register or sign in. You must agree to these Terms before you use the forum. If you do not agree, you can keep using the rest of the App, but not the forum.
2. About the App
Daily Dilemma is a reflection and hypothetical scenario app made available for general informational and entertainment purposes. The App includes daily dilemmas, a community forum, AI-assisted philosopher dialogue, bookmarks, and related learning content. The App is intended to assist users in thinking through questions and exploring relevant philosophical concepts, but it is not intended to replace independent judgment, professional advice, formal philosophy education, or psychological or personality assessment.
3. Eligibility and Age Requirements
You must be at least 13 years of age to use the App.
If you are between 13 and 18 years of age (or under the age of majority in your place of residence), you may only use the App with the permission and supervision of your parent or legal guardian. By permitting you to use the App, your parent or legal guardian agrees to be bound by these Terms on your behalf and is responsible for your use of the App
4. Licence to Use the App
Subject to your compliance with these Terms, a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence is granted to you to download, install and use the App on a device that you own or control, solely for your personal, non-commercial use.
No ownership rights in the App are transferred to you. All rights not expressly granted are reserved.
5. Acceptable Use
There is no tolerance for objectionable content or abusive users. Objectionable content includes material that is unlawful, defamatory, abusive, hateful, harassing, threatening, obscene, or otherwise objectionable. Daily Dilemma may remove that content and may suspend or terminate access for anyone who posts it or who abuses other users. You can report objectionable content and block abusive users inside the App. Blocking immediately removes that user's posts and comments from your app, and Daily Dilemma will also review and remove the related content as soon as it can.
You agree that you will not:
use the App for any unlawful, fraudulent or improper purpose;
copy, reproduce, modify, adapt, translate, distribute, sell, lease or commercially exploit any part of the App except as expressly permitted by applicable law;
reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the App, except to the extent such restriction is prohibited by law;
interfere with or disrupt the operation, security or integrity of the App;
use bots, scripts, scrapers or other automated means to access or interact with the App without prior written permission;
upload, submit or transmit any content that is unlawful, defamatory, abusive, hateful, obscene, infringing, misleading or otherwise objectionable; or
use the App in any manner that could harm the App, its users or any third party; or
post or submit content in the forum in breach of the in-app community guidelines (including by including real names or private contact details, posting harassment or hate, or seeking medical, legal, or emergency advice through the forum).
Access to the App may be suspended or terminated at any time if it is reasonably believed that these Terms have been breached.
6. User Content
If the App allows you to submit, post, save or otherwise make available any text, reflections, answers, comments or other content ("User Content"), you remain responsible for that User Content.
You represent and warrant that:
you own or control all rights necessary to submit the User Content;
the User Content does not infringe any third-party rights, including intellectual property, privacy or confidentiality rights; and
the User Content complies with these Terms and applicable law.
A non-exclusive, worldwide, royalty-free licence is granted to Daily Dilemma to host, store, reproduce, process and display User Content solely to the extent reasonably necessary to operate, maintain, improve and provide the App.
No obligation exists to monitor User Content, but any User Content may be removed or restricted at any time if it is considered unlawful, inappropriate or inconsistent with these Terms.
7. Intellectual Property
The App, including its design, software, text, graphics, prompts, compilations, branding, logos, features and other content, is owned by or licensed to Daily Dilemma and is protected by applicable intellectual property laws.
Except for the limited licence granted under these Terms, no right, title or interest in or to the App is granted to you. You must not remove, alter or obscure any copyright, trade mark or other proprietary notices contained in or displayed through the App.
8. Privacy
Use of the App is also subject to the Daily Dilemma Privacy Policy, which explains how personal data is collected, used, stored and otherwise processed. By using the App, you acknowledge that you have read the Privacy Policy.
Where the App collects or processes personal data in Hong Kong, Daily Dilemma intends to handle such personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and other applicable legal requirements.
9. No Professional Advice
The App, including all content, features, prompts, suggestions, responses, ratings, recommendations and other materials made available through Daily Dilemma (collectively, "Content"), is provided for general informational, entertainment and personal decision-support purposes only. It does not constitute legal, medical, mental health, financial, therapeutic or any other form of professional advice. The App and the Content should not be relied on as a substitute for independent judgment or consultation with an appropriately qualified professional.
Some Content, responses or recommendations in the App may be generated automatically using artificial intelligence or similar technologies, including philosopher dialogue, forum philosopher openings, and forum philosopher replies. Philosopher names in these features denote AI guides drawn on philosophical traditions—they are not the historical figures themselves. Such outputs are role-play simulations for reflection and learning; they are not verified quotations and may be inaccurate, incomplete, outdated, biased or otherwise unsuitable for your circumstances. Where replies display source badges, those badges link to cited works when available; you may tap a badge to review the source, and you should always verify citations before academic, professional, or public use. You are solely responsible for evaluating any such output and for exercising your own judgment before relying on or acting on it.
The App is not intended for use in emergencies, crisis situations or other high-risk circumstances, including situations involving personal safety, mental health crises, medical needs, criminal issues or other urgent matters requiring qualified professional assistance or emergency services. If you require urgent help, you should contact the appropriate emergency services or a qualified professional immediately.
10. Usage Limits and Fair Use
To protect the App, its users, and service availability, Daily Dilemma may apply reasonable technical limits, including limits on posting, commenting, reporting, AI requests, or other interactions. Attempts to circumvent these limits or misuse connected features may result in suspension or restriction of access.
11. User Responsibility
You are solely responsible for your decisions, actions and omissions in connection with your use of the App and the Content, and for any consequences arising from them. No responsibility is accepted for how you interpret, apply or rely on any Content or output made available through the App.
12. Disclaimers and Warranties
While efforts may be made to provide useful and engaging Content, no representation, warranty or guarantee is given that the App or any Content will be accurate, complete, reliable, suitable, secure, available, uninterrupted or up to date.
To the fullest extent permitted by applicable law, the App, the Content and all related features and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory. This includes any implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability and uninterrupted operation.
Nothing in these Terms excludes, restricts or limits any liability that cannot lawfully be excluded, restricted or limited under applicable law.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Daily Dilemma, its owner, developers, affiliates, licensors and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of profits, revenue, business, opportunity, goodwill or data, arising out of or in connection with your access to, use of, inability to use, or reliance on the App or the Content.
To the fullest extent permitted by applicable law, Daily Dilemma, its owner, developers, affiliates, licensors and service providers shall also not be liable for any claim, cost, expense, injury, loss or damage arising out of or relating to any decision, action or omission made by you in reliance on the App or any Content.
14. Third-Party Services and Links
The App may contain links to third-party websites, tools, services, advertisements or content that are not owned or controlled by Daily Dilemma. Such third-party materials are provided for convenience only.
No responsibility is accepted for any third-party content, terms, policies, practices, availability or services. Your dealings with third parties are solely between you and the relevant third party.
15. User-Generated Content Disclaimer
To the extent the App permits user submissions, comments or other User Content, that content reflects the views of the users who submit it and not those of Daily Dilemma. No endorsement is given in respect of any User Content, and no responsibility is accepted for its accuracy, legality, safety, appropriateness or completeness.
You understand that you may encounter User Content that is inaccurate, offensive, unlawful or otherwise objectionable, and you access such content at your own risk. That does not permit objectionable content or abusive users. There is no tolerance for them, and section 5 applies.
16. Suspension and Termination
Access to the App may be suspended, restricted or terminated at any time, with or without notice, if it is reasonably considered necessary, including where you have breached these Terms, created risk or possible legal exposure, or where the App or any part of it is discontinued.
Upon termination, the rights granted to you under these Terms will immediately cease and you must stop using the App.
17. Changes to the App and These Terms
The App or any part of it may be modified, suspended or discontinued at any time without liability.
These Terms may also be updated from time to time. The updated version will become effective when made available through the App or otherwise communicated to you. Your continued use of the App after the updated Terms take effect constitutes your acceptance of the revised Terms.
18. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
Subject to any mandatory rights you may have under applicable law, the courts of Hong Kong shall have exclusive jurisdiction to hear and determine any dispute arising out of or in connection with these Terms or your use of the App.
19. Miscellaneous
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be severed to the minimum extent necessary and the remaining provisions shall remain in full force and effect.
A failure or delay in exercising any right or remedy under these Terms does not constitute a waiver of that right or remedy.
These Terms, together with the Privacy Policy and any other policies or guidelines expressly incorporated by reference, constitute the entire agreement between you and Daily Dilemma in relation to your use of the App.
